Article I. Name
Section 1: The name of this organization shall be the East Stroudsburg University Student Senate, SAA, Inc. Hereafter referred to as the Student Senate.
Section 2: Wherever the term University is used it should be understood to mean East Stroudsburg University.
Article II. Purpose
Section 1: To promote the general welfare of the students of the University.
Section 2: To constitute a medium for expressing student opinion on matters of general interest.
Section 3: To provide experience for its members in leadership and the practice of democratic government.
Section 4: To charter and oversee University student organizations.
Section 5: To administer the allocation of Student Activity funds.
Section 6: To perform any duty necessary in the accomplishment of the above stated purpose.
Article III: Membership and Election of Senators
Section 1: The Student Senate shall base its membership on the following criteria: Membership of the Student Senate shall consist of Executive Officers as mentioned in Article IV, coordinators of all standing committees, Parliamentarian/Historian, chairperson of special and ad-hoc committees, and a maximum of 32 elected senators.
Section 2: Each class (freshman, sophomore, junior, senior) will be guaranteed 5 senate seats. There will be 2 guaranteed seats for graduate students. The remaining senate seats will be filled on an at-large basis by the highest remaining vote getters, regardless of class.
Section 3: Criteria for class standing shall be those set forth in the East Stroudsburg University Student Handbook.
Section 4: These elections shall be in accordance with the Student Senate Election by-laws.
Section 5: The Student Senate, as a whole, may call a senatorial vacancy election at any time to meet adequate representation needs.
Section 6: All senators will take the following oath at their first senate meeting: I, ________________, do solemnly swear that I will faithfully execute to the best of my ability the office of Student Senator of East Stroudsburg University, S.A.A., Inc. The new officers will perform the same action substituting the title of their office for "Student Senator."
Article IV. Election of Officers.
Section 1: The elected officers of the Student Senate shall consist of the President and Vice President. The student body shall elect the officers during the month of April or May.
Section 2: The election procedures for all officers will follow the statutes set in the election by-laws.
Section 3: The positions of secretary and treasurer will be elected by the Student Senate in April or May.
Article V. Appointment of the Executive Board
Section 1: The following directors appointed by the President, shall serve as members of the Executive Board along with the President, Vice-President, Secretary and Treasurer: Coordinator of Academic Affairs, Coordinator of Extra Curricular Affairs, Coordinator of Finance, Coordinator of Student Affairs, Coordinator of Public Relations and Coordinator of Special Events, and the Parliamentarian/Historian.
Article VI. Qualifications of Senators
Section 1: Senators shall stand for election each academic year and must be in satisfactory academic standing (2.0 QPA or higher).
Section 2: There shall be no grade requirements for Senators who have accumulated less than eight credits.
Article VII. Duties of a Senator
Section 1: Each Senator shall:
- Attend all meetings of the Student Senate
- Join at least one of the standing committees enumerated in Article X and attend all of its meetings.
- Join at least one of the University Wide Committees and attend all of its meetings.
- Assist with the supervision of all election tables.
- Perform other duties as assigned by the student senate.
- Attend a student senate information retreat.
- Perform three (3) Student Senate Service Hours a semester.
- Perform three (3) Student Senate Service Hours at one special event each semester in addition to the three (3) hours indicated in Article VII, Section 1-G.
Article VIII. Qualifications of Officers
Section 1: The elected officers and coordinators shall be elected and/or appointed for one term and must be in good academic standing (2.5 QPA or better), good social standing (not on disciplinary probation), and must be current students as defined by the Registrar's Office of the University.
Section 2: The student senate shall base the criteria for officers on the following basis; individuals seeking these positions must have completed the listed number of credits. President: 45 credits Vice President: 45 credits
Section 3: The offices of the President, Vice President, Secretary and Treasurer must have at least two full semesters of service as a Student Senator or Executive Board member prior to June 1 of that academic year.
Section 4: Elected officers shall be sworn into office immediately following the elections and assume the duties of that office at the end of the current academic year.
Article IX. Duties of Officers
Section 1: The President of the Senate shall:
- Preside over all meetings of the Student Senate.
- Appoint the Coordinators of the Executive Board.
- Appoint the chairpersons of all special and ad-hoc committees.
- Represent the Student Senate on the SAA Board of Directors as chairperson of that board.

- Act as or appoint a designee to act as the Student Senate representative to the Council of Trustees Academic Affairs and Student Affairs sub-committees respectively.
- Perform other duties assigned by the Student Senate.
- Have the authority to call a general meeting of the Student Senate whenever considered advisable by an officer.
- Only cast a ballot in order to break a tie vote.
- Carry on the privileges afforded the President under Robert's Rules of Order.
- J. Act as a liaison between the Student Senate and the University Coordinating Council.
- Participate in the Office of Student Development Internship for the Student Senate President.
- Serve as an ex-officio member of all committees of Student Senate.
- Assist the treasurer in preparation of the Student Senate budget.
- Sign the budget of SAA, Inc, and insure that the appropriate administrators sign it.
- Serve as the East Stroudsburg University Student Senate representative to the Board of Student Government Presidents of the State System of Higher Education.
- The President can review the executive board composition and make changes to the executive board through the amendment process.
Section 2: The Vice President shall:
- Preside over the Student Senate in absence of the President.
- Represent the Student Senate on the SAA Board of Directors.
- Succeed the President for the remainder of his/her term, in the event of a vacancy in the position of President.
- Have voting power on all issues in the Student Senate.

- Perform other duties assigned by the President or the Student Senate.
- Serve as an ex-officio member of all standing committees of Student Senate.
- Be responsible for filling University Wide Committees.
- Be responsible for the interpretation of parliamentary procedure at all Student Senate meetings as dictated by this Constitution and Robert's Rules of Order.
- Be responsible for convening senators for at least one special meeting during the fall semester to inform them on parliamentary procedures.
- Be responsible for governmental relations between Senate and the local, state, and federal government.
- Record and Maintain up to date records of all Student Senate service hours.
Section 3: The Treasurer shall:
- Be responsible for all of the Student Senate's financial transactions and their preparation.
- Give a financial report at each Student Senate meeting.
- The Treasurer is responsible for a voucher system.
- Have voting power on all issues in the Student Senate.
- Perform other duties as assigned by the President and/or Student Senate.
Section 4: The Secretary shall:
- Be responsible for all minutes of the Student Senate and any other meeting required by the Student Senate.
- Be responsible for attending the required SAA Board of Directors and Student Senate meetings.
- Be responsible for attendance records at the Student Senate meetings and committee meetings.
- Be responsible for notifying members of their termination from office due to excessive absences.
- Maintain communication between the Student Senate and the other 13 State System of Higher Education Universities Student Government/Student Senate Organizations.
- Perform other duties as assigned by the President and/or Student Senate.
Section 5: The Parliamentarian/Historian shall:
- Assist the President and the Student Senate in conducting business in accordance with the current edition of Robert's Rules of Order, Newly Revised.
- Be responsible for the motions and the Robert Rules during the meeting.
- Maintain updated files of past and present Student Senators of East Stroudsburg University.
- Maintain membership lists of the Student Senate.
- Perform other duties as assigned by the President and/or Student Senate
Article X. Committees
Section 1: The six standing committees of the student senate shall be the Academic Affairs, Finance, Extra Curricular Affairs, Student Affairs, Public Relations, and Special Events.
Section 2: The coordinator of each committee will set the date of each meeting of his/her committee. The coordinator may call special meetings whenever he/she considers it advisable. He/she shall organize, supervise, and help conduct the activities of his or her committee. He/she shall present a report at each Student Senate meeting and at each Executive Board meeting. He/she shall have voting power in Student Senate.
Section 3: Its coordinator and the President will determine the charge of each standing committee, with each focusing on the following:
- Academic Affairs: Deals with various aspects of an academic nature of interest to students. Acts as a Student Senate representative to the Council of Trustees Academic Affairs Sub-Committee. Also serves as a member of the University General Education and Curriculum Committee.
- Finance: The finance committee deals with monetary aspects of SAA organizations. Formulates the annual SAA Budget. Reviews and revises the budgets of each organization and approves the funds to be allotted from the Student Activity Fee collected from each student. The Student Senate must approve all actions. It has the authority, in conjunction with the Director of SAA, Inc. to freeze the account of any SAA budgeted organization if it feels the organization is not functioning within the prescribed fiscal policies of the SAA. The Coordinator of the Finance Committee also represents the Senate on the SAA Board of Directors.
- Extra Curricular Affairs: Reviews and processes the constitutions of all prospective and recognized organizations. Ensures that activities of organizations are consistent with all SAA policies. Allocates office space in the University Center Organization Complex. Advises on policies concerning structure and procedure of SAA organizations' meetings, events, constitutions and privileges. The Coordinator of Extra Curricular Affairs also represents the Student Senate on the SAA Board of Directors.
- Student Affairs: Deals with problems that concern students, which are not under the jurisdiction of the aforementioned standing committees. These may include but are not limited to student rights and responsibilities, student services and campus safety. Attends the Council of Trustees' Student Affairs Sub-Committee meetings.
- Special Events: Conducts all special events throughout the year such as, but not limited to: coordinating all homecoming events, fundraisers, and charitable events as they pertain to the Student Senate. This committee will also be responsible for the Student Senate election and banquet.
- Public Relations: Publicizes all Student Senate events and services. Serves as a liaison between the Student Senate and all media outlets.
Article XI. Advisors
Section 1. The Student Senate shall elect an Advisor from the professional staff or faculty to serve as the daily contact to the group. The name of this person shall be placed on all officer cards, minutes, etc.
Section 2. The Advisor shall serve until Student Senate chooses a replacement.
Section 3. The purpose of the Advisor is to advise on issues concerning the Student Senate. The Advisor does not enjoy the privileges of a senator. This person may only advise the Student Senate; may provide facts and knowledge to the Student Senate; and may assist in promoting good student-faculty relations. The Advisor shall verify the academic eligibility of senators each semester.
Section 4. The Vice President for Student Affairs must approve the advisor.
Article XII. Termination of Senators
Section 1. Senators shall be removed from office only with sufficient grounds for dismissal.
Section 2. Sufficient grounds for dismissal of Senators include two unexcused absences from Student Senate meetings, University Wide Committee meetings and/or standing committee meetings during a semester. Each missed meeting will count as a full absence towards the two unexcused absence procedure. The failure to maintain a minimum of a 2.0 QPA, malfeasance of student funds or failure to perform duties enumerated in Article VII will also ensue toward dismissal.
Section 3. A senator removed from office as per section 2 shall not be eligible to run for a new position for one academic semester. A senator removed for a second time will no longer be eligible to run for a new position for the remainder of their time at ESU.
Section 4. The Executive Board may grant exceptions for extraordinary circumstances.
Article XIII. Line of Succession
Section 1. The President/acting President shall be deemed absent if he/she is away from the University for a period of more than three consecutive days, has a scheduled meeting off campus, or declares him/herself absent.
Section 2. The following is the line of succession: Vice President, Secretary, Treasurer
Section 3. If the entire line of succession has been completed, the power of the Student Senate would rest with the Vice President for Student Affairs.
Article XIV. Impeachment of Officers
Section 1. Any member of Student Senate may initiate impeachment proceedings.
Section 2. Sufficient grounds for the impeachment of officers includes: failure to perform duties enumerated in Article IX, incompetence, or malfeasance of funds.
Section 3. As action for impeachment must be initiated by a written request signed by 10 or more members of the Student Senate, which then shall be presented at the next Student Senate meeting for discussion. This petition shall then be submitted to the highest-ranking officer (President, Vice President, Secretary, Treasurer) not being impeached. This petition must be submitted at least 5 business days prior to the next Student Senate meeting for discussion.
Section 4. The Student Senate will then decide with a two-thirds affirmative vote of those present for the removal of the officer. There must be a quorum before any officers can be impeached.
Section 5. The Student Senate shall appoint a Court of Appeals only when the individual who has been impeached submits a written request for an appeal. Appeals are heard on the basis of lack of due process, unsubstantiated evidence or new evidence. Members of the Court of Appeals shall be:
- Three members of the student body who are not elected members of Student Senate. These members will be selected by the advisor and the Vice President for Student Affairs.
- Two members of the Student Senate who shall be chosen by plurality vote of the Student Senate.
- The Vice President for Student Development and the advisor, who shall serve as non-voting members.
Section 6. There shall be at least one week between the announcement of the impeachment and the meeting of the Court of Appeals.
Section 7. A majority vote of the Court of Appeals shall finalize the removal of the impeached officer or shall determine any probationary measures.
Article XV. Meetings
Section 1. The Student Senate shall hold a meeting every other week. The President shall decide the day and time.
Section 2. The President may call a special Student Senate meeting for a specific purpose at any time. Such a meeting shall be held only after a 24-hour notice to each Senator and Officer.
Section 3. Any five Senators may call a special Student Senate meeting for a specific purpose at any time. Such a meeting shall only be held after a 48-hour notice to each Senator and Officer.
Section 4. A quorum of the Student Senate shall consist of a majority of the active membership of the Student Senate. No official business may occur without a quorum.
Section 5. The Student Senate meetings shall be organized and conducted according to Robert's Rules of Order.
Section 6. Any member of the Student Body, Faculty/Administration, Staff may attend a regular meeting of the Student Senate. Their presence will be documented in the minutes of that particular meeting.
Article XVI. Amendments
Section 1. Amendments to this constitution may be made at any time (addition, change or deletion).
Section 2. Any amendments made shall be printed and made available for review by the East Stroudsburg University student body at least two (2) weeks prior to a Senate vote.
Section 3. Approval of two-thirds of the voting members of the Student Senate and approval of the Vice-President of Student Affairs is necessary to amend this constitution.
